“Three things cannot be long hidden: the sun, the moon, and the truth.” Buddha

The Ballymurphy Families were in court today 11th October 2018 for an update on the tracing and identification of soldiers involved in the Ballymurphy Massacre. This has been a running issues since the inquests reopened in November 2010, the MOD have used every trick in the book to stall and block the inquests even presenting the court with 4773 soldiers names 6 days before the inquests started, all this was designed to do was swamp the court and stall the inquests. Families learned today in court that the list didn’t even include information that would identify if soldiers served in Ballymurphy at the time.

Mr McDonald QC for the Murphy Family raised concerns that the deadline for receiving military statements had passed weeks ago and that a “cut off” time should be issued. After that subpoenas should be issued to soldier who are not cooperating to compel them to attend the inquest.
Justice Keegan agreed that a cut off time should be put in place and that other options could be considered including adverse inference should soldiers refuse to attend. Council for the corner Mr Doran accepted that the court would have to consider issuing subpoenas to those who are reluctant to cooperate.

The corners office wrote to Regimental Associations, including the Parachute Regiment and the Queen Regiment asking them to provide information. Today families learned, in correspondence to the court, that the regimental association refused to provide information on the basis that the data protection legislation would “act as a barrier” to releasing information. Council for the coroner Mr Doran told the court that a response had been drafted that would “take issue “with that suggestion. No surprise there that the regimental associations are up to the same tactics as the MOD anything to stall the process.

Families will be in court again next Wednesday 17th October 2018 12 noon.

On Sunday morning, the American Ancient Order of Hibernians visited the Ballymurphy area to pay their respects to the victims of the Ballymurphy Massacre.

Upon visiting each of the spots where the victims were murdered, the AOH promised to take what they had learned back home to the Irish American community.

The families of the Ballymurphy victims met with two AOH representatives who heard testimonies from them about how their loved ones were shot

The representatives were told in great detail how the victims met their fate at the hands of those who were meant to be protecting them.

The families outlined how their loved ones were murdered in their own area some 47 years ago.

The National Vice-President of the AOH, Danny O’Connell and Secretary Jere Cole heard how Father Hugh Mullan was shot as he waved a white handkerchief ,brothers of the late Frank Quinn, Liam and Pat went into detail of how frank was murdered going to the aid of Fr Mullan and the wounded Bobby Clarke.

They were told how Danny Teggart was shot fourteen times with a high velocity rifles and how Joan Connolly was shot by the army and then left out in the open to bleed to death.

The victim’s families showed Mr O’Connell and Mr Cole photographs of Ballymurphy around the time of the massacre. These photographs demonstrate the close proximity of Father Mullan’s house and the field he was shot in. They also show how close the vantage points of the paratroopers were.

The families visited the manse field where four of the Ballymurphy victims were shot, among them was Mrs Connolly and Mr Teggart.

Mrs Connolly’s daughter Philomena spoke about her mother and how she was murdered on that day along with six others.

The families along with Mr O’Connell and Mr Cole, visited the other spots where the victims had lost their lives.

John Laverty’s sister went into detail abut how her brother was shot dead along with another man Joseph Corr.

She spoke of her other brother, Terry, and how he had tried to make it home to safety but was stopped by the paratroopers.

Terry was sentenced to 6 months imprisonment on that day for riotous behaviour. Some years later this conviction was overturned.

The delegation were also informed of Pat McCarthy and John McKerr who also lost their lives at the hands of the British Paratroopers on the third day of the masscare

The families finished the tour at the spot on the Whiterock Road where Eddie Doherty was killed. Eddie’s sister Kathleen gave detail about her brother’s death and how he was shot in the back also.

John Teggart, son of Danny Teggart said:

“It was some hard-lifting for the two visitors from the Ancient Order of Hibernians but I do think that it brought home to them that this did happen.

“On that first day, on August 9th, six people were murdered. This happened on a bright summers night and it happened at close range. They were carefully aimed shots, direct shots, and in the end, there was no forensic evidence to suggest that any of our loved ones were anywhere near rifles.

“There was no ammunition recovered, no guns recovered and there were no security personnel shot in that proximity. This all proves that our loved ones were killed, they were shot in the back.”

Mr Taggart has said that there is a campaign of fake news happening by some newspapers at the minute and that some politicians are insisting that the Ballymurphy Massacre has already been investigated and calling for an amnesty for these soldiers.

“The sole people who investigated Ballymurphy were the Royal Military Police. When politicians say that Ballymurphy was investigated they are referring to the investigation done by the friends of those who were being interviewed who murdered our loved ones.

“Just like the Widgery inquiry, if they had taken statements off of these soldiers and it didn’t sum up as the Royal Military Police liked, they crafted them to suit their version of events.

“All the RUC did was take photographs of our loved ones in the morgue and maybe statements from those who had identified them.

“Anybody who says that Ballymurphy was investigated needs to think about the brutality of the Royal Military Police over those three days in Ballymurphy. Then they can see if it was a proper investigation.”

The Ballymurphy Massacre Families would like to thank Danny , Jere and the AOH for their continued support.

The Ballymurphy Massacre Committee is in receipt of a letter from the Historical Enquiries Team (HET) announcing that it has suspended its “reviews” of cases involving the British Army due to the damning report by Her Majesty’s Inspectorate of Constabulary (HMIC). This acknowledgement by the State publicly and officially validates what the Ballymurphy families have been saying to each British Secretary of State as far back as Shaun Woodward–that the HET is not independent. Due to the great work by Dr. Patricia Lundy they are now having to listen and concede.

It is inexcusable in an environment that is claimed to be a democracy, that from August 1971 til the present day, there has never been an investigation into the murder of 11 innocent civilians from our neighborhood. Successive governments have ignored this atrocity and attempted to divert the cause of justice by offering only a desktop review of the 11 cases through the HET. With the HMIC condemning the HET policies and practices which their report refers to as “illegal,” the State has no excuse not to conduct a proper investigation.

As the HET letter to the Ballymurphy families indicates, there is now no mechanism through which the British State is dealing with Army murders in Ballymurphy. In the 40 year absence of any proper investigation, the Ballymurphy families have designed a formula to address this.

The Independent Panel proposal presented to both governments by the Ballymurphy Massacre Committee is based on the Hillsborough Independent Panel which was fully supported by the British government.

We now call for both the Irish and the British governments to respond immediately to the Ballymurphy Independent Panel proposal.

By Michael McHugh, Press Association

Northern Ireland’s senior coroner has suspended inquests into a dozen

controversial killings because of potential national security concerns, it

emerged today.

The senior lawyer advising the Stormont Executive, attorney general John Larkin

QC, has referred the cases to the coroner’s service for new inquests in an

effort to shed further light on the deaths which sparked years of disagreement

over what happened.

Some go as far back as 40 years.

But the coroner John Leckey said he feared Mr Larkin may have overstretched his

powers and the matter could go before the High Court in Belfast.

Details of the disagreement emerged as a preliminary hearing into one of the

killings due to go ahead today was suddenly adjourned.

Fiona Doherty, a barrister for the family of Francis Rowntree, who was hit by a

rubber bullet fired in disputed circumstances by British troops during rioting

in the lower Falls area of Belfast in April 1972, said: “This is a bolt out of

the blue.”

Mr Leckey is to write to Northern Ireland Secretary Theresa Villiers and the

attorney general after he received an expert legal opinion on the matter seeking

clarification.

He told today’s hearing in Belfast that Northern Ireland’s coroners had arrived

at a view that the attorney general may acted outside his powers (ultra vires).

“Clearly the attorney general takes a view as to his jurisdiction and powers

which is diametrically opposed,” he said.

Mr Larkin’s office was established in 2010 but his powers are restricted, with

some areas like national security remaining a matter for the Northern Ireland

Secretary, and it is disputed by the coroner whether the attorney general had

the power to order inquests into material touching on national security issues.

Mr Leckey said part of the legislation surrounding his role had been amended

without consultation with coroners, who had not been advised of an amendment

having been made.

“National security was clearly to be an issue for some (inquests),” he said.

Last week a solicitor for the coroner wrote to the attorney general outlining

the legal opinion and received a reply yesterday, but the coroner said Mr Larkin

took a diametrically opposed view to his own.

He has now written to the Secretary of State and attorney general advising them

of his decision not to proceed with any of the cases referred from the attorney

general.

“Coroners will not be taking any action on the section 14 orders. Ultimately

this is a matter which may have to go before the High Court for a resolution,”

he said.

Among inquests suspended is the hearing into the loyalist murder of Gerard

Slane in 1988. A preliminary hearing was also due to be heard today.

Mr Slane, 27, a father of three, was shot dead by the loyalist Ulster Defence

Association at his home at Waterville Street, west Belfast, on September 23.

His murder led to allegations of collusion between loyalist paramilitaries and

the security forces.

Brian Nelson, a UDA man working for British intelligence, was implicated in the

shooting.

Ms Doherty, who also represents the Slane family, said she was surprised by

today’s announcement.

She told the coroner: “This is a bolt out of the blue for us and for these

families who have had this direction in respect of coroners’ inquests for quite

some time. It seems to us to be discourtesy of the highest order that these

families expecting an inquest to be held into the death of their loved ones have

not been informed that this (arose).

“I don’t know why you have any reason to believe that the attorney general

acted inappropriately in these cases or that the attorney general did not have

knowledge that the amendment had been made. I do not know why it seems to be

considered appropriate for the coroners to interfere in a direction made by the

attorney general personally in the full knowledge of his powers and jurisdiction

in general.”

The Executive Council of the Irish Congress of Trade Unions Congress (ICTU) has agreed to support the campaign for an independent investigation into the 1971 killing of eleven civilians by the British army’s Parachute Regiment in Ballymurphy, West Belfast.

Congress President Eugene McGlone has confirmed that the ICTU will formally raise the issue with authorities in both Dublin and Belfast, stressing the need for a full independent investigation into the 1971 killings. The decision follows a meeting between Congress and representatives of the Ballymurphy Massacre Campaign and was welcomed by Mr McGlone.

“The people of Ballymurphy are entitled to truth and justice – something which they have been denied for over 40 years now. The Irish Congress of Trade Unions fully endorses and supports their campaign for justice and for a full investigation into those terrible events.

“We will be raising this with the authorities in both Dublin and Belfast at the earliest possible opportunity: the people of Ballymurphy can no longer be denied justice, they can no longer be denied access to the truth,” Mr McGlone said.

The 11 civilians were killed by members of the British Parachute Regiment in August 1971, following the introduction of internment without trial across Northern Ireland. Among those killed were a mother of eight and a priest who had been tending to the wounded.

While the British authorities have recently agreed to the re-opening of the inquests of 10 of those killed, it has refused to establish an independent investigation, as demanded by Ballymurphy residents

Relatives of 10 people shot dead by paratroops in west Belfast in 1971 have welcomed the decision to hold new inquests into their deaths.

The families said the decision by Attorney General John Larkin was an important step in their ongoing campaign for justice.

The Army said it opened fire in the Ballymurphy area in response to gunfire from republican paramilitaries.

The families have long called for an independent inquiry into the killings.

The victims, which included a priest and a mother-of-eight, were killed over the course of three days in August 1971 by members of the Parachute Regiment during Operation Demetrius, when people suspected of paramilitary activity were interned.

The Northern Ireland Office has ruled out any public inquiry into the killings akin to the Bloody Sunday Tribunal.

In a statement the families of the victims said: “We commend the attorney general for showing leadership and credibility in announcing that the inquests will be re-opened.

“We feel that when he considered the facts surrounding the sham inquests which took place 40 years ago, his decision was the correct one.

“We regard the original sham inquests as a serious neglect of duty by everyone involved and leave a lot of questions to be answered.”

The statement added that the new inquests would be an “important step on our journey for truth”.

“But even a fully resourced and effective inquest will have limitations,” the families said.

“We believe that only an International and Independent Investigation can facilitate the discovery of the facts and provide an accurate historical account of the events of August 1971 on the streets of Ballymurphy.”

‘Fully cooperate’

The Ministry of Defence said it was “aware that the attorney general has re-opened inquests into a number of deaths which occurred in the Ballymurphy area of Belfast in 1971.

“The Ministry of Defence will cooperate fully with the Coroner’s court,” it added.

SDLP West Belfast MLA Alex Attwood said Mr Larkin’s decision underlined the need for a full international inquiry into the atrocity.

“The decision by the attorney general on the Ballymurphy massacre is a step in the right direction. This decision vindicates the campaign of the families for truth and justice,” he said.

“This development, however, serves to confirm that it is a public, international inquiry that is needed to give the families the means to truth that their campaign demands.”

The MP for West Belfast, Sinn Fein’s Paul Maskey, also said a full inquiry was needed.

“This is a welcome announcement by the attorney general and moves the campaign for justice for the Ballymurphy Victims a step closer,” Mr Maskey said.

“But while this is an advance in the campaign it should not be seen as fulfilling the demands of the families to a full independent international inquiry.”
